Discussion of a master’s thesis on “Applicable Law”.
A master’s thesis in the College of Law discusses the law applicable to unilateral legal actions. With the blessing of God Almighty, the College of Law at the University of Fallujah discussed on Thursday, February 13, 2025, a master’s thesis in private law titled ((The law applicable to unilateral legal actions)) and submitted by the master’s student, Muhammad Jassam Ibrahim. The issue of the law applicable to unilateral legal actions, characterized by an international character, receives attention from the law. And jurisprudence, although Iraqi law has made the individual will a source of obligation, it too has followed the same approach, leaving this issue without an explicit text that addresses it. The study took the broad concept of these actions, which is every physical act or action issued by a single will and on which the law has a legal effect, whether the will of the person disposing of it is directed to arranging this effect or not, and the study showed how The description of unilateral legal actions as international in accordance with the legal standard, and regarding the subjection of unilateral actions to the contract-specific attribution controls, the study found the possibility of applying these controls to unilateral actions after interpreting them in a way that agrees with the nature of unilateral legal actions, and then showed how the attribution varies as a result of the diversity of unilateral legal actions, some of which are subject to the personal law of the administrator, and some of which are subject to the local law, i.e. the law of the country in which The action arose on its territory. The study also came up with a proposal for a basic support officer, which applies to unilateral legal actions that create an obligation for the originator of the action, and backup controls. As for unilateral legal actions that are considered beneficial acts or harmful acts, the study came up with a proposal for a basic support officer for them, who is the officer of the place where the action was created, and a reserve officer who is the officer of the place most closely related to the action. The discussion committee consisted of: Prof. Dr. Suleiman Barak Dayeh, Chairman, Prof. Dr. Nizam Jabbar Talib, Member, Prof. Dr. Nafi Bahr Sultan, Member, Prof. Dr. Saad Hussein Abd, Member and Supervisor. After extensive study of the thesis and the discussion committee hearing the student’s defenses for his thesis, the committee decided to accept the thesis and award the student a master’s degree.
