With God’s blessing, the Psychological Counseling and Educational Guidance Unit held the workshop entitled (The Iraqi legislator’s policy of moderation and rejection of extremism in the Iraqi Personal Status Law) on Tuesday, 3/26/2024, in which teacher Thaer Awad Abdullah lectured. It included highlighting the position of comparative legislation for the Personal Status Law, which is experiencing a state of stagnation and stagnation due to its restriction to a specific reference from Islamic jurisprudence. The Iraqi legislator has gotten rid of this situation. By adopting a unique method that preserves moderation and establishes the equality stipulated in the Iraqi Constitution of 2005 in Article (14) of it, which is not to restrict oneself to a specific doctrine that is resorted to in the event of a lack of legal text, but rather to search for all the doctrines that are most appropriate for this law, which is what was stipulated in Article (1/2) of the amended Personal Status Law No. (188) of 1959. This approach gives the judge ample room for flexibility, rejecting fanaticism, and maintaining moderation that It was imposed by the phrase (appropriateness) mentioned in the paragraph above.
