A master’s thesis at the College of Law, University of Fallujah, discussing the penalty of deprivation of the benefits of private real estate ownership. With God Almighty’s blessings. On Thursday, 7/4/2024, the College of Law discussed a master’s thesis in private law titled ((The penalty of deprivation of the benefits of private real estate ownership)) and submitted by master’s student Ahmed Jassim Yahya. The law requires the protection of private real estate property from the act of usurpation that affects it as an illegal act, as the law imposes a penalty for reparation. Damage, and to ensure the legally established sanctity of infringement, the law removes the usurped hand from the usurped property, and obliges him to return it to its owner, with the obligation to compensate for the benefit of the property that was deprived of him without reason, in the form of a similar fee. The position of the Iraqi judiciary on this is determined by tracking the decisions and rulings issued by it. The Iraqi judiciary, in the event that the squatter is an official state department, decides not to return the property or remove the encroachment, and it has also taken to ruling on compensation for one time instead of a similar fee from However, it was based on the law, or even an acceptable justification for what it said, which raised many problems that cannot be solved, and we reached the conclusion that the sanctity and maintenance of private real estate property is not achieved in practice when illegal seizure by official departments occurs. The discussion committee consisted of: Prof. Dr. Suleiman Barak Dayeh, Chairman, Prof. Dr. Saddam Faisal Cooks, Member, Prof. Dr. Hammam Muhammad Yaqoub, Member, Prof. Dr. Dara Hammad Abd, Member and Supervisor. After a study After examining the thesis in detail, and when the discussion committee heard the student’s defenses for his thesis, the committee decided to accept the thesis and grant the student a master’s degree.
