Doctoral thesis: “Forcible transfer of private property.”
A doctoral thesis at the College of Law, University of Fallujah, discussing the forced transfer of private property from the owner. On Tuesday, 7/2/2024, the College of Law discussed a doctoral thesis in private law entitled ((Forcible transfer of private property from the owner)) and submitted by the doctoral student (Muhammad Jamal Zain). Ownership is considered one of the most sacred and oldest rights, which legislation has set out to protect and prevent assault on, under penalty of liability. It is not permissible to take it away except for the public benefit. - No one is deprived of his property except in the circumstances stipulated by the law - However, if one examines some of the topics of civil law, and those related to property, and the reasons for gaining it, he will find that they are vivid images of depriving the owner of his property for a private interest, and not for a public benefit. The legislator dealt with various topics, such as pre-emption, forced sale, possession of benefits and excesses, attachment to human action, and usurpation, which in reality represent images of the forceful transfer of property from its owner. The need arose for such a study that draws attention to the reading of this forced transfer, examines its forms, and then removes the contradiction between the legal texts, if there is any. The discussion committee consisted of: Prof. Dr. Saad Hussein Abd, Chairman, Dr. Suleiman Barak Dayeh, member, Dr. Saddam Faisal Cooks, Member, Dr. Amal Kazem Saud, Member, Professor. Sahar Hayal Ghanem, Member Dr. Shield Hammad Abd, member and supervisor. After extensive study of the thesis and the discussion committee hearing the student’s defenses for his thesis, the committee decided to accept it and grant the student a doctorate.
