A master’s thesis at the College of Law, University of Fallujah, discussing the law applicable to contracts related to intellectual property. With the blessing of God Almighty, and in the presence of (Prof. Dr. Sabah Ibrahim Hammadi), President of the University of Fallujah, the College of Law discussed on Thursday, 11/2/2023, a master’s thesis in private law, tagged ((The law applicable to contracts related to intellectual property)) and submitted by student Nour Naji Ibrahim. Intellectual property rights are considered among the most common rights nowadays. circulation and influence in the legal, commercial and competitive environment, especially in the field of knowledge industry and production. The subject of these rights and the privileges that arise from them has become the subject of many contracts in which intellectual property or one of its products is the basis of its existence and the essence of its content. Thus, a group of contracts has been created that are directly or indirectly linked to intellectual property and its knowledge production, whether when it is produced or when it is circulated or exploited and used. The research thought is directed towards studying the contractual relationship that arises between those who produce it. Innovation or authorship of the work, whether it is a single author, worker, or group of individuals linked by the bond of participation or collective authorship, and the one who exploits and benefits from that intellectual production, whether an employer, company, factory, or commercial institution. Likewise, the contractual relationship may arise between the owner of the trademark and the one who exploits it within the framework of contracts that exceed the territorial scope of a specific country, or it may be affected by a foreign element that leaves the contract outside the framework of subjection to internal law.
