Doctoral thesis: “Reforming the tort system.”
A doctoral thesis at the College of Law, Department of Private Law, discusses reform of the tort liability system in Iraqi civil law. With the blessing of God Almighty, the College of Law discussed on Thursday, 5/2/2024, a doctoral thesis in private law tagged ((Reforming the tort liability system in Iraqi civil law)) and submitted by the doctoral student (Ahmed Khairy Ahmed). The tort liability system is one of the most important and influential legal systems in daily life, and the one that raises the most legal problems. It is more developed than other legal systems, so it has remained the focus of in-depth research, jurisprudential studies, and judicial jurisprudence. It is an area of ​​research and diligence, especially in light of the economic and social developments accompanying the terrible technological development in machines and equipment. Perhaps the tort liability system is one of the few systems that is still the subject of many points of view among jurists and judges in search of the comprehensive legal basis that prevents tort liability, and which achieves the justice sought by researchers and specialists in the legal fields. Some look at it. From an ethical standpoint, he believes that it is not possible to hold a person accountable for an act unless this act is characterized by a mistake, while others see that every act that causes harm to others requires compensation for the damage, while Islamic jurisprudence has its own point of view in the field of the tort liability system, through its distinction between the direct act and the cause. This distinction has implications in terms of the right of the injured person to obtain compensation or not. As for the Iraqi legislator, he has regulated tort liability greatly influenced by the idea of ​​wrongdoing, even if he tries. Formally keeping pace with Islamic jurisprudence, which requires the intervention of the Iraqi legislator to take major steps towards reforming the tort liability system in the Iraqi civil law, in a way that is consistent with the great development that life has witnessed in various fields. The discussion committee consisted of: Prof. Saad Hussein Abd, Chairman, Prof. Dr. Suleiman Barak Dayeh, Member, Prof. Dr. Saddam Faisal Cooks, Member, Prof. Dr. Samira Hussein Mohsen, Member, Prof. Dr. Ahmed Muhammad Siddiq, Member. Prof. Dr. Shield Hammad Abd, Member and Supervisor. After extensive study of the thesis and the discussion committee hearing the student’s defenses for his thesis, the committee decided to accept it and award the student a doctorate degree.
