Discussion of a master’s thesis on “Innovated Margins.”
A master’s thesis at the College of Law, University of Fallujah, discussing the effects resulting from the new marriage. With the blessing of God Almighty, the College of Law discussed on Thursday, 11/30/2023, a master’s thesis in private law, tagged ((The legal effects resulting from the new marriage - a study in the field of personal status)) submitted by the master’s student, Jabbar Ibrahim Abbas. Recently, many marriages have spread that were not familiar to the Islamic community before. The reasons behind the spread of this marriage have varied: some of them are due to reasons of a social and economic nature, as well as ignorance of the provisions of Islamic law, and conflicting fatwas from clerics regarding the legality of this marriage. New marriages are: marriages that individuals have created at the present time, or marriages that have changed the basis of the ruling; As a result of social developments and economic changes, and due to the abundance of these new marriages; I tried to shed light on the most common of them, among Muslims in the East and West of the world, so I chose five types of this marriage, which are: misyar marriage, secret customary marriage, marriage with the intention of divorce, friendship marriage, and civil marriage. The importance of this study lies in clarifying the legitimate and legal ruling on this marriage, and showing the extent of its conformity with the correct marriage, and whether the Iraqi legislator has dealt with this marriage, or it has been referred to indirectly in the Personal Status Law, as the intended purpose of this study is to reveal the truth about the nature of this new marriage, the degree of its impact on achieving psychological and family stability, or its lack thereof, and showing the extent to which the financial and non-financial effects that can result from it have been achieved. A committee was composed of Discussion by: Prof. Dr. Qahtan Hadi Abd, Chairman, Prof. Dr. Khaled Hamad Fayyad, Member, Prof. Dr. Abdul Rahman Saleh Latif, Member, Prof. Dr. Adel Nasser Hussein, Member and Supervisor. After extensive study of the thesis and the discussion committee hearing the student’s defenses for his thesis, the committee decided to accept the thesis and award the student a master’s degree.
