Contracts of their many types are concluded to achieve goals and objectives desired by their parties, and these The goals and objectives will not be achieved unless they are implemented on the ground. Merely concluding the contract in the correct legal manner will not be sufficient for its purpose to be achieved. Rather, what is required is for the two parties to begin implementing the obligations required by the contract’s entry into force and its validity between them. Therefore, beginning to implement the obligation is the first window to achieving the desired goals of the contract. Without the care exerted by the parties contract, and either or both of them initiate the implementation of the contractual obligation. In reality, it is not possible to talk about an effective and valid contract that achieves economic goals. Without specifying who is the party on whom the burden of initiation falls, we can enter into the problem of contract dormancy, as it represents a realistic reflection on the effectiveness and validity of the contract. Therefore, legislators were interested in determining who is the party who initiates implementation. His commitment to many provisions, especially in the texts of the Iraqi Civil Code, the Egyptian Civil Code, and the French Civil Code.
