Discussion of a master’s thesis on “Application of the Judge’s Law to International Investment Contract Disputes.”
A master’s thesis at the College of Law at the University of Fallujah discusses the application of the judge’s law to international investment contract disputes. With God Almighty’s blessings. On Thursday, 11/9/2023, the College of Law discussed a master’s thesis in private law tagged ((Application of the judge’s law to international investment contract disputes)) submitted by master’s student Sarah Thamer Hamad. Investment has become a matter of interest, whether for the country hosting the investment or the foreign investor, and its importance has increased in Iraq in particular at the present time due to the presence of a large number of Of the huge investment projects, most of which were from foreign companies, it became necessary to explain how the national judge’s law is applied to a dispute tinged with a foreign element, by considering the application of the judge’s law in two cases, the first of which is when he is the one who has the original jurisdiction when the substantive rules exist, and the second is when the judge’s law is the one who has reserve jurisdiction through what this requires, and to explain the position of the Iraqi legislator and his role in developing this field. The discussion committee consisted of: Prof. Dr. Abdul-Rasul Abdul-Rida Jaber Chairman, Dr. Dara Hammad Abd, Member, Prof. Dr. Majeed Ahmed Ibrahim, Member, Prof. Dr. Suleiman Barak Dayeh, Member and Supervisor. After extensive study of the thesis and the discussion committee’s hearing of the student’s defenses for her thesis, the committee decided to accept the thesis and award the student a master’s degree.
