In a scientific step that enriches the legal and academic library, the College of Law at the University of Fallujah witnessed today, Monday (July 20, 2026), the public defense of a doctoral dissertation entitled:
"Contracting by Fraud – A Comparative Study with Islamic Jurisprudence"
presented by researcher Mustafa Tahrir Mohammed in candidacy for the degree of Doctor of Philosophy in Private Law.
Scope and Significance of the Study
The dissertation shed light on one of the most intricate topics in the general theory of contract, given its substantial impact on:
- Protecting contractual intent and ensuring its soundness against defects.
- Reinforcing legal security and consolidating the pillars of stability in financial and civil transactions.
- Conducting a foundational comparative analysis between the provisions of civil law and the parameters of Islamic jurisprudence.
The study was distinguished by its identification of shortcomings in the current Iraqi legislative framework, along with presenting a developmental vision and concrete legislative proposals aimed at achieving a precise distinction between lawful and unlawful fraudulent devices, all grounded in the richness of Islamic jurisprudential thought.
