Master's Thesis Discussed at College of Law on the Legal Regulation of the Commercial Establishment

On Monday, July 21, 2025, the College of Law discussed a Master's thesis in Private Law entitled:

"The Legal Regulation of the Commercial Establishment - A Comparative Study"

The thesis was presented by Master's student Noor Abdulqadir Hamad.

The commercial establishment is considered the tool used by a merchant to carry out commercial operations. When engaging in trade, the merchant needs the commercial establishment. People have begun to distinguish between the merchant and their business, paying attention to other factors such as the establishment's location and reputation. Consequently, the significant importance of certain elements has emerged, such as the trade name, trademark, patents, and industrial designs. Likewise, the great importance of the element of clientele connection and commercial reputation has become apparent. Therefore, the commercial establishment has come to consist of tangible and intangible elements; these elements are combined for the purpose of commercial exploitation.

The commercial establishment is the means through which the merchant conducts their activities to achieve profit. It is a legal entity that combines the tangible and intangible elements formed by the merchant for use in carrying out commercial activity. The commercial establishment is an intangible movable asset subject to legal rules that differ from the rules governing each individual element.

The element of clientele connection and commercial reputation is considered one of the most important elements. As for the other intangible elements, the importance of each increases or decreases depending on the nature of the commercial activity.

The Examining Committee consisted of:

  • Assoc. Prof. Dr. Mohammed Lateef Saleh (Member)
  • Prof. Dr. Sahar Rashid Hameed (Member and Supervisor)

After thorough examination of the thesis and hearing the student's defense of her work, the committee decided to accept the thesis and award the student the Master's degree.

A thousand congratulations to the student on this commendable effort, and onwards to the PhD, God willing!
