A master’s thesis at the College of Law discussing the role of will in extending legal situations. With the blessing of God Almighty, the College of Law discussed on Sunday, 10/27/2024, a master’s thesis in private law, tagged ((The role of will in extending legal situations - a comparative study)) and submitted by master’s student Amna Fares Abdel Wahed. Extension is a situation in which the legal situation continues to be effective and enforceable, after its term has expired, as the legal situation that has expired returns or continues to be in effect for a period exceeding The period specified for it, and this continuity or return is sometimes by law, sometimes by will, and other times by judicial ruling, so the legal situation returns after its expiration, and continues and extends before the expiration of its term, whether by the same source according to which it arose or without the source that created it. The legal situation can arise initially by a voluntary agreement concluded between the parties, but it continues and returns or is extended by the text of the law or by the rule of the judiciary. The legal situation can also arise by the rule of law, and it expires and returns. Extended by agreement of the parties. In this study, the focus is on the role of will in the process of extending legal statuses in its various forms, in light of the legal system on which the extension is based, and the mechanism in which it takes place, through the legal texts on the extension of legal statuses stipulated in civil law, whether this status is represented by a contract or something else, as this study sheds light on the role played by will in the process of continuation, return, or Extension of legal status. The extension of legal conditions is a system that has a valuable economic function, whether related to a contract or a non-contractual legal system, whose impact is reflected on the parties and rights holders. It helps stabilize civil transactions and achieve stability in dealings, adds a kind of contractual balance, and protects weak parties from exploitation by the strong party in legal relations. Therefore, the precise treatment of the idea of ​​the subject of the study requires us, to work according to scientific and research data, to pave the way for To enter into the heart of the study, with an introduction through which we show the end of the legal conditions, then we explain the nature of the extension of the legal conditions, and then we review the content of the role of will in the extension of the legal conditions, and in the end we show the legal effects resulting from the extension of the legal conditions. The discussion committee consisted of: Prof. Dr. Saad Hussein Abd, Chairman Prof. Dr. Dara Hammad Abd, member, Dr. Saad Rabie Abdel-Jabbar, member, Dr. Saddam Faisal Cooks, member and supervisor. After extensive study of the thesis and the discussion committee hearing the student’s defenses for her thesis, the committee decided to accept the thesis and grant the student a master’s degree.
