Master’s thesis: “Private Administrative Control in Sharia” (Student Hussein Munther).
The College of Law at the University of Fallujah discussed a master’s thesis in the branch of public law, entitled: ((Establishing private administrative control and appreciating it in accordance with the provisions of Islamic Sharia - a comparative legal study)), which was submitted by the student Hussein Munther Mashkour Mahmoud. The study aims to establish private administrative control in Islamic Sharia and its appreciation in statutory legislation, to point out the shortcomings that plague private administrative control in the law, as well as explaining the jurisprudence of Sharia policy. Related to it, since ignorance of it has led many to make mistakes in judging the Islamic administrative system and its sources. Islamic law is not the law of a time without time, nor a place without a place. Rather, it is a law of worship, morals, and politics that is valid for every time and place. It is based on ease and gentleness, and calls for facilitation, alleviation, and the removal of hardship. It is organized for the righteousness of religion and the world in people’s lives on the basis of justice and mercy for all creation, taking into account circumstances. The different and varying taxpayers in strength and weakness, and the necessities that arise from them. The thesis included four chapters, the first of which is to define the private administrative control in Sharia and the law, the second is for the means that created the private administrative control in the Sharia and the law and its structure, the third is for the goals of the private administrative control in the Sharia and the law, and the fourth is for the limits that created the private administrative control in the Sharia and the law. The researcher came up with many proposals, the most important of which is the call for provisions to be Islamic Sharia is the source of administrative law, which would achieve the desired reform of private administrative control bodies in this world and the hereafter. The discussion committee consisted of: Prof. Dr. Ali Ahmed Hassan, Chairman, Prof. Dr. Taghreed Muhammad Qaddouri, Member, Prof. Dr. Ismail Fadel Halawas, Member, Prof. Dr. Khaled Rashid Ali, Member and Supervisor. After discussing the student and hearing the committee’s defenses of the student for his thesis, the committee decided to accept the thesis and award the student a master’s thesis in public law.
