Master's Thesis Discussion
This Thursday morning, 6/11/2025, the public discussion of the master's thesis of student (Mustafa Sabah Dreeb) from the College of Law / University of Fallujah, took place. The thesis was titled [The Role of the Referral Judge in the Criminal Case - A Comparative Study] and was held in Judge (Dhiaa Shait Khattab) Hall.
The discussion committee consisted of the following esteemed professors:
• Prof. Dr. Mohammed Hameed Abdul – College of Law, Al-Iraqia University – Chairman
• Assist. Prof. Dr. Khaled Ahmed Ali – University of Fallujah / College of Law – Member
• Dr. Ziyad Abboud Majeed – University of Fallujah / College of Law – Member
• Prof. Dr. Ammar Rajab Mu'aisher – University of Fallujah / College of Law – Member and Supervisor
The primary objective of this study was to introduce the system of the referral judge. Through our research, we sought to highlight its most important positive aspects, as well as the aspects that align with those prevalent in Iraqi legislation. This was done by considering the experience of comparative legislations that adopt this system in terms of how it is organized and applied, and by clarifying the philosophy behind adopting it. The aim of introducing the system of the referral judge is to draw the attention of the Iraqi legislator to it and to demonstrate the extent to which Iraqi criminal procedural legislation needs to adopt it in its code.
The thesis included three chapters. The first chapter addressed the nature of the referral judge. The second chapter dealt with the legal regulation of the referral judiciary and its competences. Finally, the third chapter discussed the decisions issued by the referral judge and an evaluation of his role in the criminal procedural system.
The thesis concluded with several recommendations, the most prominent being:
- The Iraqi legislator should establish an independent judicial body called the Referral Scrutiny Judge, which would be consistent with the philosophy of the Iraqi legislator.
- Members of the judicial police should be subject to the supervision of the investigative judge, who should have the authority to impose disciplinary penalties when they violate their duties or are negligent in their work, without prejudice to their criminal accountability if they commit an act that constitutes a crime.
At the conclusion of the discussion, the student was awarded a "Very Good" rating after defending his thesis and the committee's discussion of his valuable subject.
