A master’s thesis at the College of Law, University of Fallujah, discussing judicial security in the theory of judgments. With the blessing of God Almighty, the College of Law discussed on Monday, August 21, 2023, a master’s thesis in private law, tagged ((Judicial security in the theory of judgments - a comparative study in the law of civil procedure)) submitted by the master’s student (Muthanna Fayez Abd). The idea of ​​the study revolves around linking judicial security with the judicial ruling as the general form of judicial work, the most important stages of civil litigation, its usual end, the intended purpose behind it, and the goal sought by the litigants, in order to inspire confidence and reassurance in the souls of the litigants in a way that suggests everyone is reassured about the justice of the judiciary, and its effectiveness in achieving its sublime mission in the best way to come out with a prudent ruling that takes into account personal data. For the litigants, there are circumstances and details related to them, and other objective circumstances related to the legal rules, the facts of the dispute, and judicial jurisprudence that emanate from that as necessary. There is no doubt that the confidence of individuals in the judicial authority and the strengthening of their confidence in the rulings and decisions it issues represent justice and the symbol of judicial truth, and the rate of confidence increases if the higher courts seek to unify their judicial principles and stabilize their work in a way that makes litigants aware of their affairs in a way that is consistent with their legitimate expectations and acquired rights without being subject to invalid rulings or different judicial jurisprudence. In the context of the study, we find a scattered legislative framework and judicial adoption of the idea of ​​judicial security in the field of judicial work when hearing cases and in formulating rulings accurately, despite their differences between the legal texts and some commentators’ opinions and various judicial rulings and decisions. The discussion committee consisted of: Prof. Saad Hussein Abd as Chairman, Prof. Dr. Yasser Bassem Dhanoun as member, Prof. Dr. Dara Hammad Abd as member. Suleiman Barak Dayeh, member and supervisor. After extensive study of the thesis and the discussion committee hearing the student’s defenses for his thesis, the committee decided to accept the thesis and grant the student a master’s degree.
