A master’s thesis at the College of Law, University of Fallujah, discussing the legal system for protecting genetic inventions. With the blessing of God Almighty, the College of Law discussed on Thursday, September 21, 2023, a master’s thesis in private law, tagged ((The legal system for protecting genetic inventions - a comparative study)) and submitted by the master’s student (Bidaa Salman Abbas), that the most prominent inventions and innovations that are happening at the present time have revolutionized the world, and the most important and most dangerous of these are innovations related to biology, which are known Genetic inventions are based on the genes of living organisms and are not limited to plant and animal genes only, but also include human genes. This is what makes them a major challenge with the rules and restrictions they impose on the various scientific, economic, ethical and legal levels. In addition to that, the great importance that these genetic inventions provide in various fields of life (health, food, medical, agricultural and industrial). From this standpoint, the idea of ​​the extent of the possibility of protecting genetic inventions and what are the means of protecting them has crystallized. Protection: Can it be protected by granting a patent for this type of invention, which has occupied the attention of most countries, especially developed ones, and made them think about establishing a legal framework to protect these inventions due to the privacy of living matter, or is their protection carried out through the general rules of intellectual property as well as the general rules of civil law? The thesis addressed the issue by dividing it into three chapters, where the first chapter was entitled Legal Description of Genetic Inventions, which included the original framework for genetic inventions by explaining their nature, concept, and legal nature, and was devoted to The second chapter discusses the legal provisions related to the protection of genetic inventions in terms of its treatment of the conditions of protection and the legal and legislative position on the protection of genetic inventions, whether in Western legislation or Arab legislation, in addition to international texts. Finally, the third chapter discusses the means by which genetic inventions are protected, whether those means come under the umbrella of intellectual property rules or under the cover of general rules in protection. The discussion committee consisted of: Prof. Dr. Suleiman Barak Dayeh, Chairman Prof. Dr. Majeed Ahmed Ibrahim Member: Prof. Dr. Mahdi Naeem Hassan, Member: Prof. Dr. Ziyad Tariq Jassim, Member and Supervisor. After extensive study of the thesis and the discussion committee hearing the student’s defenses for her thesis, the committee decided to accept the thesis and grant the student a master’s degree.
