A master’s thesis at the College of Law, University of Fallujah, discussing the subjectivity of criminal procedures in Traffic Law No. 8 of 2019. With the blessing of God Almighty. On Tuesday, 10/24/2023, the College of Law discussed a master’s thesis in public law, tagged ((The subjectivity of criminal procedures in Traffic Law No. 8 of 2019)) submitted by master’s student Muhammad Fakhri Abdel Hadi Hamad. The idea of ​​the study is embodied in the specificity of the procedures. The criminal law that was unique to the traffic law from the rest of the other procedural laws, as this law regulated some of these issues away from the procedural methods approved in the effective Iraqi Code of Criminal Procedure, amended No. (23) of 1971, which gave a kind of procedural subjectivity specific to this law, and the most prominent forms of this subjectivity is the role granted to the traffic policeman in the investigation stage, the subjectivity of the judicial authority enjoyed by traffic officers and traffic commissioners up to the fourth degree, and the nature of the authority competent to look into it. In objections to the decisions of the traffic police officer when imposing a fine, in addition to the system of dropping the penalty and the rules contained in the traffic law that contradict what is stipulated in the Code of Criminal Procedure in this field. The discussion committee consisted of: Prof. Dr. Muhammad Jiyad Zidan, Chairman, Prof. Dr. Ammar Rajab Muayshar, Member, Prof. Dr. Zaman Hamid Hadi, Member, Prof. Dr. Nagham Hamad Ali, Member and Supervisor, and after an extensive study of the thesis. After the discussion committee heard the student’s defenses for his thesis, the committee decided to accept the thesis and grant the student a master’s degree.
