A doctoral thesis at the College of Law, Private Law Department, discussing the legal problems in oil service contracts between Iraq and foreign companies. With the blessing of God Almighty, the College of Law discussed on Thursday, 10/19/2023, a doctoral thesis in private law, tagged ((Legal problems in oil service contracts between Iraq and foreign companies)) and submitted by the doctoral student (Inaam Muhammad Reda). Oil contracts went through stages They were different, and their styles and formulas were affected by the historical stage in which they were held. This happened in all oil-producing countries in the world, and in terms of Iraq’s oil history, oil has been the main engine and controller in Iraq’s contemporary economic history, since oil was discovered and its economic investment began in Kirkuk in the year 1927 by foreign investing companies, and until today, the Iraqi state’s rentier economy is based on the sale of crude oil to finance the majority of the state’s general budget. In this context, we can shed light on an important issue, related to the fact that today in Iraq, we face legal situations that are different in many of their details from what we are accustomed to in the context of internal or international contracts. After the change that occurred in the political system in the country in 2003, and the change in its economic philosophy and development orientations, the Iraqi state adopted a new type of model contracts for investment in the oil sector, which the Iraqi state, represented by the Federal Ministry of Oil, has been conducting since 2008 until now, and is represented by service contracts. Which was concluded by the Iraqi state in accordance with the oil licensing rounds, as the Iraqi Federal Ministry of Oil adopted the method of contracting according to multiple licensing rounds with foreign investing companies. These rounds are manifested in several stages that the process of selecting competitors goes through, as they include announcing the exploratory patches and the discovered or planned oil fields. Developing it, as it is supposed to achieve great economic feasibility from it, through what Iraq will benefit from these contracts, and what it aspires to increase oil production, in a way that places it in a distinguished position at the regional and global level, with the oil reserves it possesses, and the development of Iraqi economic cadres working in the oil sector. The discussion committee consisted of: Prof. Dr. Dara Hammad Abd, Chairman, Prof. Dr. Samah Hussein Ali, Member, Prof. Dr. Medhat Saleh Ghayeb Member: Dr. Sahar Rashid Hamid, Member: Professor: Dr. Majeed Ahmed Ibrahim, Member: Dr. Saddam Faisal Cooks, Member and Supervisor. After extensive study of the thesis and the discussion committee hearing the student’s defenses for her thesis, the committee decided to accept it and grant the student a doctorate degree.
