In the presence of (Prof. Dr. Sabah Ibrahim Hammadi), President of the University of Fallujah, (Prof. Suleiman Barak Dayeh), Assistant to the University President for Administrative Affairs, and (Prof. Ahmed Suleiman Hamad), Assistant to the University President for Scientific Affairs, the first doctoral thesis in the Department of Private Law at the College of Law, University of Fallujah discusses the differences of jurists in the evidence of Sharia rulings and its impact on personal status issues. With the blessing of God Almighty, the College of Law discussed on Thursday, 17 / 8 / 2023 A doctoral thesis in private law, tagged ((The difference of jurists in the evidence of legal rulings and its impact on personal status issues - a comparative study)) and submitted by the doctoral student (Hassan Munther Mashkour Mahmoud). The subject of the study is related to identifying the issues of disagreement among jurists in the legal evidence, and explaining the impact of this disagreement on rulings related to personal status issues. Through this study, it was achieved to develop a specific definition of the legal evidence and define its concept. This represents the first step towards reducing the disagreement in rulings, as the judge can, by pleading with him, issue his ruling on the issue. Through it, we explained the concept of disagreement in this evidence, its types, its control, and the arrangement of its sources, along with an explanation of the reasons on which the jurists differed in this evidence. We summarize Including the reasons related to its validity and the extent of its consideration, as well as the reasons related to its understanding, and the detail in explaining the impact of the difference in the legal evidence on the issues of the marriage contract related to its conclusion, its conditions, and its effects of maintenance, housing, and marital intercourse, and also explaining the effect of the difference in it on the issues of divorce and its conditions, taking it back and its conditions, as well as the effect of the difference on issues of separation, issues of birth, lineage, custody, and issues of breastfeeding and alimony, with a statement of the position of the Iraqi and Jordanian personal status law. The Algerian family law eliminates this difference, and the study concluded with the most important results and recommendations related to the subject of the study.
