Discussion of a doctoral thesis on the “right to be forgotten”.
A doctoral thesis at the College of Law, University of Fallujah discusses the right to be forgotten as a form of the right to privacy. On Thursday, 11/7/2024, the College of Law discussed a doctoral thesis in private law entitled ((The right to be forgotten as a form of the right to privacy - a comparative study)) and submitted by the doctoral student (Inam Dekan Khudair). The human right to forget his past to facilitate his smooth integration into society is one of the rights necessary for his life. In order for a person to feel calm and tranquil, he must acknowledge the right to keep his data, information, and emotional relationships behind the veil of oblivion. Therefore, most laws, constitutions, charters, and international agreements recognized this right and were keen to protect it as an independent right or an image of the right to privacy. Based on the above, the study sought to clarify the concept of this right, determine its legal nature, and the obstacles to its application, and explain the aspects of its connection to the elements of the right to privacy, as well as explaining the necessary legal and technical mechanisms. To activate it in the digital environment, the research came out with a conclusion that included the most important results reached on the subject, and proposals that included a call to the Iraqi legislator to enact texts that guarantee a person his right to forget his past, similar to comparative legislation. The discussion committee consisted of: Prof. Dr. Mansour Hatem Mohsen, Chairman, Dr. Suleiman Barak Dayeh, Member, Dr. Saddam Faisal Cooks, Member, Dr. Ziad Tariq Jassim, Member, Dr. Ibrahim Ali Hammadi, Member. Saad Hussein Abd, member and supervisor. After extensive study of the thesis and the discussion committee hearing the student’s defenses for her thesis, the committee decided to accept it and grant the student a doctorate.
